Constitution of the Oak Ridges-Markham Provincial Young Liberal Association
(Amended August 19, 2013)
Article 1 – NAME
This organization shall be known as the Oak Ridges-Markham Provincial Young Liberal Association
Article 2– OBJECTIVES
The objectives of the Oak Ridges-Markham Provincial Young Liberal Association shall be:
2.1 To promote and make widely known and understood, Liberal principles and policies;
2.2 To promote the election of Liberal members to Provincial Parliament;
2.3 To develop and determine policy that reflects the concerns and ideas of the members
Article 3 – JURISDICTION
3.1 This Association shall operate within the geographical boundaries of the Oak Ridges-Markham constituency and shall be affiliated with the Ontario Liberal Party.
Article 4 – MEMBERSHIP
The following shall be members of the Oak Ridges-Markham Provincial Young Liberal Association:
4.1 All persons who are between the ages of fourteen (14) and twenty-six (26) years of age shall be eligible to be members.
4.2 All members must hold valid memberships with the Oak Ridges-Markham Provincial Liberal Association. To be valid, a membership form must be filled out and a membership fee paid. The form must be processed and the membership fee collected by either the respective senior association or by the Liberal Party of Ontario
4.3 This association must have a minimum of ten (10) members at all times.
4.4 A minimum of ninety (90) percent of members must be residents of the affiliated Provincial constituency
4.5 No person is eligible for membership if they hold a current membership in another provincial riding association other than that indicated in Article 3 of this Constitution. Any member who holds such a membership shall immediately cease to be a member of the association
4.6 Any person seeking to transfer their membership to or from thus Association in the same membership year must obtain approval of the Liberal Party of Ontario office in Toronto
Article 5 – EXECUTIVE
5.1 The following shall be Officers of the Executive
(c) Financial Director
(d) Communications Director
(e) Policy Director
(f) Five (5) Directors
5.2 The Executive shall be responsible for the following:
5.2.1 Subject to the decisions of the Annual Meeting, the executive shall have charge of the general Association administration and shall be responsible for the general affairs of the Association
5.2.2 The Executive shall approve budgets and expenditures provided that a quorum of three (3) of the Executive are present and in agreement
5.2.3 The Executive shall have the power to delegate any authority they see fit to committees, which they may establish
5.2.4 Notice of Executive Meeting shall be given to each member a minimum of seven (7) days in advance of the meeting unless such notice is waived in writing by one-half (1/2) of the Executive
5.2.5 The Executive shall meet at least four (4) times per year at a time and place determined by the President
5.3 The Executive Officers shall have the following duties:
5.3.1 The President shall be responsible for coordinating the general management of the Association. The President shall chair all meetings and ensure that the Executive fulfill their responsibilities. The President shall represent the Association, including at all meetings of the Oak Ridges-Markham Young Liberal Association.
5.3.2 The Vice-President shall act in the absence of the President and shall assume any responsibilities assigned by the Executive. In the event that the position of President becomes vacant, the Vice-President shall assume the office until the next Annual General Meeting of the Association
5.3.3 The Financial Director shall be responsible for the keeping of a financial record and shall present a financial report at the Annual General Meeting of the Association. The Financial Director will also be responsible for taking a leadership role in any fundraising initiatives.
5.3.4 The Communications Director shall be responsible for recording minutes at meetings and updating the website, Facebook page, and Twitter feed in a timely manner that is consistent with the occurrence of events and other activities.
5.3.5 The Policy Director shall be responsible for representing the association, along with the Association President, at the Ontario Young Liberal Policy Forums. The Policy Director will also be responsible for organizing policy meetings within the association, and bringing forward policy resolutions at meetings.
5.3.6 Directors will be responsible for attending all meetings and taking on tasks as assigned.
5.4 Other Executive positions may be added if necessary
5.5 The President and Vice-President shall assume any responsibilities of Executive positions not filled
Article 6 – ANNUAL MEETING
6.1 The Annual Meeting of the Oak Ridges – Markham Provincial Young Liberal Association shall be held once per year at a time and place fixed by the Executive
6.2 Notice in writing must be given a minimum of fourteen (14) days prior to the date of the Annual Meeting to all members of the Association, to the Ontario Young Liberal Office and to the President of the Ontario Young Liberal Association. As part of the notice delivered to the Ontario Young Liberal Office, a copy of the current Association Constitution and a current membership list must be included
6.3 Members must be in good standing a minimum of one hundred and sixty eight (168) hours prior to the time of the meeting in order to vote at the Annual Meeting. Immediate past members may renew up to the time of the Call to Order of the meeting
6.3.1 Voting in abstentia and voting by proxy are expressly forbidden in any elections or voting of this Association
6.4 The Executive shall be elected at the Annual Meeting according to the following:
6.4.1 Candidates shall be nominated and seconded from the floor by members present
6.4.2 Candidates shall be allowed to address the Annual Meeting. The speaking time shall be determined by the Chair and the candidates shall speak in reverse order of nomination.
6.4.3 The Chair shall determine the means of balloting and may appoint a returning officer to conduct voting procedures. A secret ballot shall be taken for those offices for which more than one candidate is nominated.
6.4.4 The candidate receiving the most votes of a majority of valid votes cast shall be declared elected. In the case of a tie, a coin toss shall determine the candidate deemed to have received the most votes
6.5 Within fourteen (14) days following the Annual Meeting, the following information must be forwarded to the Ontario Young Liberal Office:
(a) the current constitution of the association, including any amendments
(b) the list of Executive Members, including addresses and phone numbers
(c) the membership list of the Association, including addresses and phone numbers
(d) the minutes of the Annual Meeting, and
(e) a list of those in attendance at the meeting
6.6 Failure to comply with Articles 6.1, 6.2, and 6.5 shall empower the Executive Committee of the Ontario Young Liberals to suspend the authority of the Association to elect delegates at any convention or meeting of the Ontario Young Liberals, the Young Liberals of Canada, and the Liberal Party of Canada (Ontario). This failure shall also empower the Executive Board of the Ontario Young Liberals to deratify the Association and recommend to the Liberal Party of Canada (Ontario) and the Young Liberals of Canada to no longer recognize the Association.
6.7 A person may vote in only one Provincial Association membership per year.
6.8 Quorum for an Annual Meeting shall be ten members or ten (10) percent of members eligible to vote, whichever is greater.
Article 7 – OTHER MEETINGS
7.1 General meetings of the Oak Ridges-Markham Provincial Young Liberal Association shall be called by the Executive for the purposes of electing delegates for any other purpose
7.2 Notice in writing must be given to a minimum of fourteen (14) days prior to the date of the meeting to all members of the Association and the President of the Oak-Ridges Markham Provincial Liberal Association. In the case of a Delegate Selection Meeting, notice must also be given to the Ontario Young Liberal Office. As part of the notice delivered to the Ontario Young Liberal Office, a copy of the current Association Constitution and a current membership list must be included.
7.3 In the case of Delegate Selection Meetings, the proceedings must comply with the requirements of the Ontario Young liberals, Liberal Party of Canada (Ontario) or the Young Liberals of Canada, whichever is appropriate.
7.4 Voting in absentia and voting by proxy are expressly forbidden in any elections or voting of this Association
7.5 Members may vote in only one Provincial Association in any one membership year
7.6 Quorum for General Meetings shall be five (5) members eligible to vote or ten (10) percent of members eligible to vote, whichever is greater
Article 8 – CONSTITUTION
8.1 This constitution may be amended by a two-thirds (2/3) vote of the members present and voting at an Annual Meeting.
8.2 Notice that amendments to the constitution may be proposed and voted on at the AGM shall be provided to the members along with the notice of the meeting.
8.3 Where this constitution is silent, the Constitution of the Ontario Young Liberals shall hold authority. Where this constitution is in conflict with the constitution of the Ontario Young Liberals, the Constitution of the Ontario Young Liberals shall have authority.
